FITTIN INC (FITTIN) respects the privacy of users of its products and services and complies with applicable laws for the protection of your privacy, including, without limitation, the European Union General Data Protection Regulation ("GDPR") and the Swiss and EU Privacy Shield Frameworks.
THE MAIN THING YOU SHOULD KNOW: WE USE YOUR DATA ONLY TO FULFILL OUR CONTRACT WITH YOU, TO FULFILL THE REQUIREMENTS OF THE LAW, TO RESOLVE CONFLICTS BETWEEN US.
ONLY EMPLOYEES WHOSE DIRECT RESPONSIBILITIES INCLUDE WORKING WITH YOUR DATA HAVE ACCESS TO THEM, THESE EMPLOYEES HAVE THE NECESSARY PROFESSIONAL SKILLS FOR DATA PROTECTION, AND USE DATA ONLY WHEN IT’S NECESSARY. YOUR DATA IS STORED SECURE UNDER THE APPLICABLE STANDARDS.

1. DEFINITIONS

Personal Data below is any information that can either itself identify you as an individual ("Personally Identifying Information") or that can be connected to you indirectly by linking it to Personally Identifying Information. FITTIN also processes anonymous data, aggregated or not, to analyze and produce statistics related to the habits, usage patterns, and demographics of customers as a group or as individuals. Such anonymous data does not allow the identification of the customers to which it relates.
Virtual 3D models – models of your feet, which you get by scanning feet with the FITTIN application (s).
Application (APP) -a mobile application developed by FITTIN that allows you to create 3-D models of feet, for the further purchase (order) of shoes.
User - an individual who has authorized / registered in the Application.

2. WHY FITTIN COLLECTS AND PROCESSES DATA

FITTIN collects and processes Personal Data for the following reasons:
a) where it is necessary for the performance of our agreement with you to deliver Services;
b) where it is necessary for compliance with legal obligations that we are subject to (e.g. our obligations to keep certain information under tax laws);
c) where it is necessary for the purposes of the legitimate and legal interests of FITTIN or a third party (e.g. the interests of our other customers), except where such interests are overridden by your prevailing legitimate interests and rights.
3. WHAT DATA WE COLLECT AND PROCESS

3.1 Basic Account Data
When setting up an Account, FITTIN will collect your telephone number. You are also required to choose a user name and a password. The provision of this information is necessary to register a FITTIN Account. During setup of your account, the account is automatically assigned a number (the "FITT ID") that is later used to reference your user account without directly exposing Personally Identifying Information about you.
3.2 Virtual models of users ' feet.
By using our Application you create virtual 3D models of users ' feet are created. The models we use are not biometric data – in any case, based on their accuracy and other parameters, you cannot be identified by them. You can send the data (virtual 3D-model) to third parties (workshops and shops) by exporting the data using the application’s tool. In this case, you should be guided by agreements and contracts with such third parties.
3.3 Other Data You Explicitly Submit. We will collect and process Personal Data whenever you explicitly provide it to us or send it as part of communication (chats, or when you provide feedback or other user generated content).
3.4 Personal Data we collect may include, but is not limited to device information, data collected through automated electronic interactions and application usage data.
3.5 In order to provide you with services, we need to collect, store and use various information about your activity in our APP. "APP-Related Information" includes your FITT ID, as well as what is usually referred to as "user statistics".
3.6 Information Required to Detect Violations.
We collect certain data that is required for our detection, investigation and prevention of fraud, cheating and other violations of the SSA and applicable laws ("Violations"). This data is used only for the purposes of detection, investigation, prevention and, where applicable, acting on of such Violations and stored only for the minimum amount of time needed for this purpose. If the data indicates that a Violation has occurred, we will further store the data for the establishment, exercise or defense of legal claims during the applicable statute of limitations or until a legal case related to it has been resolved. Please note that the specific data stored for this purpose may not be disclosed to you if the disclosure will compromise the mechanism through which we detect, investigate and prevent such Violations.
3.7 The user can transfer the 3D-model’s data to the third party with the built-in APP tools, to further manufacture (purchase) shoes from third party. User has the right not to transfer this data.
The user can apply to FITTING at info@fittin.com with the claim to delete his data, including his 3D models.
3.8 The APP supports multiple user profiles. Any user, regardless of whether he installed the specified application, performing any action related to the Application (viewing, scanning, etc.) accepts the terms of this EULA. Users solely monitor the safety of their profiles.
3.9. The user is aware that by posting reviews and comments, as well as photos to them, which by their purpose and meaning are addressed to an indefinite circle of persons (sellers, site visitors and other users of the Application, etc.) are available for general viewing, for copying and further distribution. Accordingly, the information specified by the User should be communicated and published with special selectivity at its discretion. FITTIN LLC is not responsible for possible moral or material harm that may be caused to the User, third parties, as a result of any impact on the User using his personal data published by the User himself on the website and its services, or in the Application.
4. COOKIES

FITTIN uses some necessary cookies because they allow users to navigate and use key features on the site.

A cookie is a small text file that stores Internet settings. Almost every website uses cookie technology. The cookie is downloaded by your Internet browser the first time you visit a website. The App may contain links to other websites, mobile applications, and other online services operated by third parties. These links are not an endorsement of, or representation that we are affiliated with, any third party. In addition, our content may be included on web pages or in mobile applications or online services that are not associated with us. We do not control third party websites, mobile applications or online services, and we are not responsible for their actions. Other websites, mobile applications and online services follow different rules regarding the collection, use and sharing of your personal information. We encourage you to read the privacy policies of the other websites, mobile applications and online services you use.
6. HOW LONG WE STORE DATA

We will only store your information as long as necessary to fulfil the purposes for which the information is collected and processed or — where the applicable law provides for longer storage and retention period — for the storage and retention period required by law. After that your Personal Data will be deleted, blocked or anonymized, as provided by applicable law.

7. WHO HAS ACCESS TO YOUR DATA

Only the following categories of personnel have access to your data:
 a) personnel with responsibilities to work with your data. Anyway, they have access only to that part of the data that is necessary to perform their direct duties

5.2 FITTIN may release Personal Data to comply with court orders or laws and regulations that require us to disclose such information.


8. YOUR RIGHTS AND CONTROL MECHANISMS

The data protection laws of the European Economic Area and other territories grant their citizens certain rights in relation to their Personal Data. While other jurisdictions may provide fewer statutory rights to their citizens, we make the tools designed to exercise such rights available to our customers worldwide.
The minimum age to create a FITTIN User Account is 18. FITTIN will not knowingly collect Personal Data from children under this age. Child Account must be registered only by child’s legal representative.
FITTIN encourages parents to instruct their children to never give out personal information when online.


9. CHANGES TO THE PRIVACY POLICY

We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by posting it on the App. Any modifications to this Privacy Policy will be effective upon our posting the new terms and/or upon implementation of the new changes on the App (or as otherwise indicated at the time of posting). In all cases, your continued use of the App after the posting of any modified Privacy Policy indicates your acceptance of the terms of the modified Privacy Policy.

10. LAW, JURISDICTION AND DISPUTE RESOLUTION

This Privacy Policy and any disputes or claims arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of Delaware. You irrevocably agree that the courts of Delaware have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with the Privacy Policy or its subject matter or formation (including non-contractual disputes or claims).
